Consumer Rights

Are you being repeatedly called by a debt collector? Did you know that there is a law that actually protects you against this and other harassing, threatening, misleading or abusive actions in order to collect a debt? It’s called the Fair Debt Collection Practices Act (FDCPA). Under FDCPA, a bank, creditor, or debt collection agency seeking payment may not use any false, deceptive or misleading information while collecting a debt. Even if you have suffered a debilitating personal injury and are being pursued by debt collectors, you are protected and have rights.

If you feel you have been harassed by a debt collector, you may have a case and may be entitled to monetary damages, having the outstanding debt reduced or eliminated, clearing your credit report of negative information, and/or having the debt collector pay your attorney’s fees. Deming Law can discuss your experiences with you to determine the potential for a case. By reviewing correspondence and communications from the debt collector, we may be able to identify if the practices violated the FDCPA.
